1.Agreement to these terms
These Terms of Service ("Terms") govern your use of elytrastudios.com and any content, tools or enquiry forms on it (the "Site"), operated by Elytra Studios ("we", "us", "our").
By using the Site you accept these Terms. If you do not accept them, please stop using the Site.
Separate written agreements govern any project we deliver for you. Where a signed agreement and these Terms conflict, the signed agreement wins.
2.Who may use the Site
You must be at least 16 years old and able to enter a binding contract. If you are using the Site for an organisation, you confirm you are authorised to accept these Terms on its behalf.
3.What we do
Elytra Studios designs and builds AR, VR, XR and MR experiences, games, 3D models and design, metaverse environments, websites and mobile applications.
The Site is a showcase and a way to reach us. Nothing on it is a binding offer to provide services. Scope, timelines, fees, ownership and warranties for actual work are agreed separately in a proposal, statement of work or contract.
4.Acceptable use
You agree not to:
- Break any law, or infringe anyone's rights, while using the Site;
- Attempt to gain unauthorised access to the Site, its admin areas, servers or databases;
- Probe, scan or test the Site's security, or interfere with its normal operation;
- Scrape, crawl or harvest content or contact details at scale, or use them to train a model without our written permission;
- Upload anything malicious, or use our forms to send spam or unlawful, deceptive or abusive content;
- Misrepresent your identity or your association with any person or organisation.
We may suspend or block access to the Site if we reasonably believe any of the above is happening.
5.Our intellectual property
The Site, and everything in it — text, layout, design, code, graphics, 3D assets, video, and the Elytra Studios name and logo — belongs to us or our licensors and is protected by copyright, trade mark and other laws.
You may view the Site and share links to it. You may not copy, reproduce, republish, adapt or distribute any part of it commercially without our written permission.
Portfolio work is shown with our clients' permission. Client brands, trade marks and product names belong to their respective owners and are shown for identification only.
6.Content you send us
You keep ownership of anything you send us through the Site — briefs, messages, files and attachments. By sending it, you grant us a non-exclusive licence to use it for the purpose of responding to you and, if we work together, delivering the project.
You confirm you have the right to send us what you send, and that it does not infringe anyone else's rights. Please do not send confidential material through the contact form before we have a confidentiality agreement in place.
7.Third-party links and content
The Site links to and embeds third-party services, including video players, review widgets, scheduling tools and map tiles. We do not control those services and are not responsible for their content or practices. Your use of them is governed by their own terms and privacy policies.
8.Availability
We aim to keep the Site available but do not guarantee uninterrupted or error-free access. We may change, suspend or withdraw any part of it, including individual pages or features, without notice.
9.Disclaimers
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, express or implied, including fitness for a particular purpose and non-infringement. Statistics, case studies and results shown on the Site describe past projects and are not a promise of any particular outcome.
10.Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, goodwill or business opportunity, arising from your use of the Site.
Our total liability arising from or connected to the Site is limited to PKR 10,000 or the amount you have paid us for access to the Site (which is normally nothing), whichever is greater.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law. If your local law does not allow some of these exclusions, they do not apply to you.
11.Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Site, or content you send us that infringes someone else's rights.
12.Privacy
Our Privacy Policy explains what personal information we collect and why. Our Cookie Policy explains cookies and how to change your choice. Both form part of these Terms.
13.Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows the current version. Continuing to use the Site after a change means you accept the updated Terms.
14.Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Lahore have exclusive jurisdiction over any dispute. If you are a consumer in the EEA or UK, this does not deprive you of protections available under the mandatory law of your country of residence.
